2. Purpose

This legal notice governs access to and use of the website evolve-cars.com (the "Website"), owned by FAM TINASEP, S.L. Accessing the Website makes you a user and implies acceptance of the terms set out in this legal notice.

3. Terms of use

3.1. Users undertake to use the Website and the content and services it offers diligently, in accordance with the law, this legal notice and good practice.

3.2. The Website may not be used for unlawful or harmful purposes, nor in any way that could damage, disable or overload it or prevent its normal use.

3.3. Users shall not use automated means to extract the Website's content on a large scale without the owner's prior written authorisation.

4. Information about vehicles and services

4.1. The information published about the vehicles (prices, availability, mileage, equipment and photographs) and about the services is for information only and is not a binding contractual offer. Availability may change at any time because of sales or reservations, and the definitive details of each vehicle are those set out in the contract.

4.2. Vehicle prices are shown including VAT.

4.3. The website does not sell or reserve vehicles. Purchases, reservations and import orders are agreed in writing with Evolve Cars, with the terms of each transaction: price, payment method, documentation and delivery.

4.4. Reservations. A reserved vehicle is held for the agreed period. If no period is agreed, the reservation lasts for a maximum of 14 calendar days; if the purchase has not been completed by then, the vehicle may be put back on sale.

4.5. Import orders. Before buying the vehicle, Evolve Cars provides the quote and the terms of the order in writing.

4.6. Warranty. Each vehicle's warranty is the one stated on the invoice or in the sales contract, in accordance with the rules applicable to the sale of used vehicles by professional sellers.

4.7. Delivery. Vehicles can be collected from the premises or delivered to an address in Spain under the agreed terms. Deliveries outside Spain are agreed in the contract.

4.8. Returns. Once the sale has been completed, returns are not accepted except in the cases provided by law, such as consumers' right of withdrawal when the contract is concluded at a distance.

4.9. Calculators. The financing simulator and the registration tax calculator give indicative amounts. They are neither a financing offer, which depends on approval by the lender, nor a tax assessment.

4.10. Complaint forms. Consumers may ask Evolve Cars for the official complaint forms (fulls oficials de queixa, reclamació i denúncia).

5. Intellectual and industrial property

5.1. The Website's content (texts, photographs, design, source code, logos and trademarks) is protected by intellectual and industrial property law and belongs to FAM TINASEP, S.L. or to third parties who have authorised its use.

5.2. Reproduction, distribution, public communication or transformation of the content without the owner's express authorisation is prohibited, except for the uses permitted by law.

5.3. Vehicle manufacturers' names and trademarks are used only to identify the vehicles and belong to their owners.

6. Links

6.1. The Website may contain links to third-party sites. The owner does not control those sites and is not responsible for their content or their privacy policies.

7. Limitation of liability

7.1. The owner does not guarantee that the Website will be continuously available or free of errors, although it will take reasonable measures to prevent and correct them.

7.2. The owner is not liable for damage resulting from improper use of the Website by users or for interruptions attributable to third-party service providers.

8. Data protection

8.1. The processing of personal data is governed by the Website's Privacy policy.

9. Governing law

9.1. This legal notice is governed by Spanish law.

9.2. Disputes shall be resolved by the courts that have jurisdiction under the applicable law. Where the user is a consumer, the courts determined by mandatory law shall have jurisdiction.
